These Terms of Service (“Terms”) govern your access to and use of ElevenX Plugins products, including the ElevenX Image Alt Manager WordPress plugin (“Plugin”), the alt-text-checker-proxy.elevenx.workers.dev proxy service (“Proxy Service”), and the elevenxplugins.com website (“Website”), collectively (“Services”).
By installing, activating, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. License
1.1 Free Tier. Subject to these Terms, ElevenX Plugins grants you a limited, non-exclusive, non-transferable, revocable license to install and use the free version of the Plugin on websites you own or operate.
1.2 Pro License. Purchase of a Pro license grants you a limited, non-exclusive, non-transferable license to install and activate Pro features of the Plugin on the number of websites specified in your license agreement. Pro licenses are per-site unless otherwise stated.
1.3 Restrictions. You may not: (a) sublicense, sell, resell, transfer, or assign the Plugin or your rights under these Terms to any third party; (b) modify, reverse-engineer, decompile, or disassemble the Plugin except as expressly permitted by law; (c) remove or alter any proprietary notices or labels on the Plugin; (d) use the Plugin to build a product or service that competes with ElevenX Plugins.
1.4 Open Source Components. The free version of the Plugin is distributed via the WordPress.org plugin repository under the GNU General Public License v2 or later (GPL-2.0+). The GPL governs that distribution and supersedes any conflicting provision of these Terms with respect to open-source-licensed components.
2. Proxy Service
2.1 Purpose. The Proxy Service (alt-text-checker-proxy.elevenx.workers.dev) acts as an intermediary between your WordPress site and third-party AI services to generate alternative text descriptions for images.
2.2 Data Transmitted. When you use the AI alt-text generation feature, the following data is transmitted to the Proxy Service:
- Image data in base64-encoded format
- Your WordPress site’s URL
- Your license key (Pro users only)
- Image metadata (file name, dimensions, MIME type)
2.3 Third-Party Processing. Image data sent to the Proxy Service is forwarded to OpenAI, LLC for AI analysis and alt-text generation. By using the AI generation feature, you acknowledge and consent to OpenAI processing your image data in accordance with OpenAI’s usage policies. We are not responsible for OpenAI’s data practices.
2.4 Availability. The Proxy Service is provided “as is” without uptime guarantees. ElevenX Plugins reserves the right to modify, suspend, or discontinue the Proxy Service at any time, with reasonable notice where feasible.
3. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Process images that contain illegal content, including child sexual abuse material
- Attempt to circumvent license key restrictions or authentication mechanisms
- Overload, abuse, or interfere with the Proxy Service beyond its intended use
- Infringe the intellectual property rights of any third party
4. Payment and Refunds
4.1 Fees. Pro license fees are charged at the time of purchase. All prices are listed in US Dollars unless otherwise stated.
4.2 30-Day Money-Back Guarantee. We offer a full refund on Pro license purchases within 30 days of the original purchase date. To request a refund, contact us at support@elevenxplugins.com. Refunds are not available after 30 days or for renewal charges already processed.
4.3 Renewals. Annual licenses renew automatically at the end of each license term unless you cancel before the renewal date.
5. Intellectual Property
All rights, title, and interest in and to the Services (excluding open-source components and WordPress core), including all associated intellectual property rights, are and will remain the exclusive property of ElevenX Plugins. These Terms do not grant you any right to use ElevenX Plugins trademarks, logos, or trade names.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, ELEVENX PLUGINS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AI-generated alt text is provided for convenience only. You are solely responsible for reviewing, verifying, and editing generated content before publishing it on your website. We make no guarantee as to the accuracy, completeness, or appropriateness of AI-generated content.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ELEVENX PLUGINS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50).
8. Termination
8.1 By You. You may stop using the Services at any time.
8.2 By Us. We may suspend or terminate your access to the Services, including the Proxy Service and Pro features, for violation of these Terms, with or without prior notice.
8.3 Effect of Termination. Upon termination, your right to use Pro features ends immediately. Free-tier plugin code distributed under GPL-2.0+ is not affected by termination of these Terms.
9. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Alabama, and you consent to personal jurisdiction in those courts.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.
